Agreement to Terms
By accessing or using the services provided by IMDESTV Inner Circle ("Company," "we," "us," or "our"), including opting in to our SMS/text messaging program, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services or opt in to our messaging program.
Program Overview
Program Name: IMDESTV Inner Circle
IMDESTV Inner Circle is a three-month 1:1 and group coaching program designed to help participants apply a disciplined, straight-bet system for sports investing, built around bankroll management and consistent execution rather than luck. The program covers bankroll and unit sizing, straight bet strategy, line movement reading, discipline habits, and access to Des's picks inside a private Discord community. By opting in to our messaging program, you may receive SMS/MMS text messages related to program updates, coaching reminders, scheduling communications, and relevant service notifications.
SMS/Text Messaging Terms
By opting in to the IMDESTV Inner Circle SMS/text messaging program, you specifically agree to the following terms and conditions:
3.1 Message Frequency
You will receive up to 3 messages per week. Message frequency may vary depending on your interactions with us, your coaching schedule, and the nature of the communications.
3.2 Message and Data Rates
Message and data rates may apply for any messages sent to you from us and to us from you. These rates are determined by your wireless carrier and your individual plan. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
3.3 Opt-Out Instructions
You can cancel the SMS service at any time. Simply text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
3.4 Customer Care and Support
If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance, or you can get help directly at team@imdestvinnercircle.com
3.5 Carrier Liability
Carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission from your network operator and is outside of our control.
Coaching Program Terms
The IMDESTV Inner Circle program runs for three months and includes 1:1 and group coaching sessions, access to Des's picks, access to proprietary frameworks and systems, and access to the private Discord community. Participation requires active engagement and consistent execution of the bankroll management and betting strategies provided. Results are not guaranteed and depend on individual effort, bankroll discipline, market conditions, and other factors outside of our control.
Use of Services
You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to use our services in any manner that could damage, disable, overburden, or impair our systems or interfere with any other party's use of the services. You further agree not to share, distribute, reproduce, or resell any proprietary materials, frameworks, systems, or intellectual property provided as part of the IMDESTV Inner Circle program.
Intellectual Property
All content, materials, frameworks, systems, and methodologies provided through the IMDESTV Inner Circle program, including but not limited to the Bankroll Unit Sizing System, the Straight vs Parlay Breakdown, the Advanced Line Movement Read, the Discipline Guide, the Cold Streak Code, and any other training materials, are the exclusive property of the Company and are protected by applicable intellectual property laws. You are granted a limited, non-transferable, non-exclusive license to use these materials solely for your personal use as part of the program. You may not reproduce, distribute, sell, or create derivative works from any part of our proprietary materials without our prior written consent.
Performance Guarantee
If you enroll in the coaching program and do not recoup your investment within three months, Des will continue working with you at no additional cost until that benchmark is reached. This guarantee is contingent upon your active participation, consistent execution of the bankroll management and betting strategies provided, and good-faith adherence to the program requirements. The Company reserves the right to determine, in its reasonable discretion, whether the participation and effort requirements have been met.
Payment Terms
Program fees and payment terms are as agreed upon at the time of enrollment. Payments are processed through Stripe, Fanbasis, Whop, including financing options where available, or through manual installment plans as arranged directly with the Company. Refund policies, if applicable, are outlined separately at the time of purchase.
Disclaimer of Warranties
Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee specific betting outcomes, income results, or profit timelines. Individual results will vary based on effort, bankroll size, discipline, market conditions, and numerous other factors. To the fullest extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall IMDESTV Inner Circle, its owners, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, our services, even if we have been advised of the possibility of such damages. Our total liability for any claims arising under these Terms shall not exceed the amount you paid for the program.
Indemnification
You agree to indemnify, defend, and hold harmless IMDESTV Inner Circle and its affiliates, owners, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses arising out of or related to your violation of these Terms, your use of our services, or any betting decisions you make using the strategies and systems taught in the program.

Your privacy is important to us. Our Privacy Policy is incorporated by reference into these Terms and Conditions.
Modifications to Terms
We reserve the right to modify or update these Terms and Conditions at any time. Any changes will be effective immediately upon posting the revised terms. Your continued use of our services after any changes indicates your acceptance of the updated terms. We encourage you to review these Terms periodically.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.
Dispute Resolution
Any disputes arising out of or relating to these Terms or the IMDESTV Inner Circle program shall first be attempted to be resolved through good-faith negotiation between the parties. If a resolution cannot be reached, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Texas. Each party shall bear its own costs and fees associated with the arbitration.
Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
